Overtime Labor Law Violations
The Fair Labor Standards Act (FLSA) is a federal law that governs wage and hour regulations, including overtime pay. The FLSA typical mandates that nonexempt employees must be paid overtime for all hours worked in excess of 40 per week.
Some employers try to avoid paying overtime by improperly classifying or reclassifying employees as salaried (exempt) when they should be paid hourly (nonexempt). In some cases, this happens when two companies merge or when new management takes over. If a successful suit is filed against the employer, the court may order back payment for overtime wages, in addition to liquidated damages, attorneys' fees and other expenses.
