Are You Being Paid for the Hours You Work?
In general, employees must be paid for all hours they work and if they are nonexempt, they must be paid overtime for hours that exceed 40 per week. There are also laws governing minimum wage requirements. In most circumstances, you must be paid at least minimum wage for the hours you work. Employees who work on commission, such as salespeople, must be paid minimum wage for hours they worked, even if they made no sales during that pay period.
The Fair Labor Standards Act (FLSA) is a federal law that provides minimum wage and overtime standards for full-time and part-time workers. If an employer violates the law under the FLSA, we can file a collective action on behalf of the employees. In Ohio, there are also wage and overtime state laws. If an employer violates these laws, we can file a class action suit. In some instances, we can file collective and class action suits against an employer.
